The European Court of Human Rights (ECtHR) Applications

The European Court of Human Rights (ECtHR, the Court) is an international judicial body that applies the European Convention on Human Rights (ECHR), to which 46 member states of the Council of Europe, including Türkiye, are parties.

The Court examines applications lodged by individuals, groups or civil society organisations against states and decides whether fundamental rights and freedoms have been violated.

The widespread human rights violations experienced in Türkiye in recent years have made the ECtHR the final avenue of recourse in the pursuit of justice.

Cases involving arbitrary detention and arrest, violations of freedom of expression, the denial of the right to a fair trial, violations of property rights, discrimination, torture and ill-treatment constitute a significant portion of the applications brought before the Court.

According to ECtHR statistics, Türkiye has in recent years been among the countries with the highest number of individual applications lodged before the Court. Türkiye also ranks first among Council of Europe member states in terms of cases in which violations have been found.

This picture clearly demonstrates that domestic remedies in Türkiye have lost their effectiveness and that individuals have been compelled to bring their pursuit of justice to the international level.

Submitting an application to the ECtHR is not merely an individual search for justice; it is also a tool of international solidarity and legal struggle for the protection of human rights.

For this reason, the ability of victims who have exhausted domestic remedies to apply to the Court depends on their proper understanding of the procedural requirements and their conscious management of the application process.

Our aim is to provide a practical, clear and reliable roadmap for individuals who have suffered human rights violations in Türkiye regarding applications to be lodged with the ECtHR in their pursuit of justice.
